Divine Rising NYC LLC ("Divine Rising NYC," "we," "us," or "our") operates the Divine Rising NYC member application ("the App"). This Privacy Policy governs the collection, use, storage, disclosure, and protection of personal information provided by users ("you" or "Member") in connection with the App.

By creating an account or using the App in any manner, you acknowledge that you have read, understood, and agreed to this Privacy Policy. If you do not agree to these terms, you may discontinue use of the App at any time.

1. Who We Are

Divine Rising NYC LLC is a limited liability company organized under the laws of the State of New York. We operate a membership-based family organization and community platform built specifically for New York City parents and guardians navigating special education, early intervention, child development, and family support systems.

The App provides members with the following core tools and features:

The App is intended to serve as a comprehensive organizational and advocacy companion for families β€” consolidating documents, preparation tools, community support, and communication resources in one secure, private platform.

The App's advocacy letter tools, IEP meeting preparation guides, and calendar deadline suggestions are built specifically for NYC families navigating Early Intervention (EI), the Committee on Preschool Special Education (CPSE), and special education systems in New York City. Suggested dates and reminders are based on NYC-specific timelines and are intended to help families stay ahead of critical deadlines within these systems.

2. Information We Collect

Account Information

Upon account creation, we collect your name and email address. Authentication credentials are managed exclusively by Clerk Authentication. We do not store passwords in plain text at any time.

Parent / Guardian Profile

You may voluntarily provide your full name, mailing address, phone number, and email address as part of your member profile. This information is stored solely to pre-fill advocacy letters and documents generated within the App. You retain the right to update or permanently delete this information at any time through your account Settings.

Children's Information

You may create child profiles containing a child's name, date of birth, grade level, school name and address, principal's name, school district, and a profile photo. This information is collected solely for the purpose of personalizing App features β€” including document organization, letter generation, and calendar management β€” for your use. We do not disclose children's information to third parties for any purpose beyond delivering the App's stated functionality to you as the account holder.

Documents and Files (The Vault)

The Document Vault enables you to upload and store personal records including IEPs, evaluations, school records, medical records, correspondence, and children's artwork. All files are encrypted in transit and at rest. Vault contents are accessible only to the authenticated account holder. We do not access, review, or disclose the contents of your Vault documents except as required by law.

AI Advocate and AI-Generated Content

When you use the AI Advocate feature (document review) or the AI Advocacy Letter Generator, the content you submit β€” including uploaded evaluation documents, your stated concerns, questions, recipient details, and contact information β€” is transmitted to Anthropic's API for AI processing. This data is processed by Anthropic subject to their privacy policy, available at anthropic.com/privacy. We do not retain your AI inputs beyond what you elect to save to your Vault. Divine Rising NYC staff do not view or access documents you submit for AI review.

Important β€” Keep Your Own Copies: Do not rely on this app as your sole backup for important documents. Always keep originals saved on your own device, in email, or in another secure location.

Divine Rising NYC LLC is not a HIPAA-covered entity and does not provide HIPAA-compliant storage. Do not upload documents containing another person's private health information without their consent.

Calendar and Event Data

Events, reminders, and dates you add to the Family Calendar are stored securely and associated solely with your account. This data is not shared with third parties.

Community Data

If you participate in the Community feature, we collect your chosen username, posts, comments, and any photos you publicly share. Your username is selected by you and does not need to reflect your real name. Members also have the option to post anonymously β€” when this option is selected, your post will appear to all other members as posted by "Anonymous Member" and your username will not be displayed publicly. Please note that anonymous posts are still associated with your account internally and may be visible to platform administrators for safety and moderation purposes. Direct messages are private between participants. Posts and comments are visible to all active members of the platform. You may delete your own content at any time. We reserve the right to remove content that violates our Terms of Service.

Payment Information

All subscription payments are processed exclusively by Stripe, Inc. We do not collect, transmit, or store credit card numbers, bank account information, or any sensitive payment data. Stripe processes payment information in compliance with PCI-DSS Level 1 standards.

All membership fees are non-refundable. Upon payment, members receive immediate full access to the App for one (1) year from the date of purchase. Because access is granted in full at the time of payment, refunds are not issued for cancellations, unused time, or change of mind.

Refunds will only be considered in the following limited circumstances: (1) a verified duplicate charge; (2) an unauthorized charge resulting from fraud or billing error; or (3) a documented technical failure on our end that prevented access to the App entirely. Refund requests based on any of the above must be submitted in writing to Connect@divinerisingnyc.com within 14 days of the charge. All other charges are final. Usage and Technical Data

We may collect limited, anonymized technical data β€” such as features accessed, session duration, and error logs β€” for the purpose of maintaining, improving, and securing the App. This data is not linked to your identity and is not sold or shared with third parties.

3. How We Use Your Information

We use the information we collect exclusively for the following purposes:

We do not use your personal information for targeted advertising. We do not sell, rent, or license your personal data to any third party for commercial purposes.

4. Children's Privacy (COPPA)

The App is designed and intended solely for use by adults aged 18 and older. Children under the age of 13 do not create accounts or directly interact with the App. Information about children is collected only as voluntarily submitted by a verified parent or guardian, and is used exclusively to deliver the App's core features to that account holder.

We do not knowingly collect personal information from children under 13 without verifiable parental consent, in accordance with the Children's Online Privacy Protection Act (COPPA). If we determine that personal information has been collected from a child under 13 without proper consent, we will delete such information promptly upon discovery or notification.

5. Data Storage and Security

Your data is stored using Supabase, a cloud infrastructure provider with row-level security that ensures each member's data is logically isolated and inaccessible to other users. Account authentication is managed by Clerk. Payment processing is managed by Stripe. Each provider maintains independent security standards, certifications, and compliance frameworks applicable to their services.

We implement reasonable and industry-standard administrative, technical, and physical safeguards to protect personal information against unauthorized access, disclosure, alteration, or destruction. No data transmission over the internet or cloud storage system can be guaranteed to be 100% secure. You are responsible for maintaining the confidentiality of your login credentials. If you suspect unauthorized access to your account, notify us immediately at Connect@divinerisingnyc.com.

We do not sell, trade, or otherwise transfer your personal information to outside parties except as described below:

Members who use the App for any unlawful purpose β€” including but not limited to harassment, impersonation, fraud, or unauthorized data access β€” forfeit any expectation of privacy with respect to information related to that conduct, and such information may be disclosed to the appropriate authorities.

7. Data Retention

We retain personal data for the duration of your active membership. Upon account deletion, personal information is purged from our systems within 30 days, except where a longer retention period is required by applicable law (including financial records required for tax or regulatory compliance purposes). Anonymized and aggregated data may be retained indefinitely for analytical purposes without restriction.

9. Cookies and Local Storage

The App may use cookies and browser local storage to maintain authenticated sessions and preserve user preferences such as language selection. We do not deploy advertising cookies or engage in cross-site behavioral tracking. You may configure your browser to block or delete cookies at any time; however, doing so may impair certain App functionality.

10. Third-Party Links

The App may contain links to external websites, government portals, or third-party resources provided for informational purposes only. Divine Rising NYC LLC has no control over and assumes no responsibility for the content, privacy practices, or data handling of any third-party sites. We encourage you to review the applicable privacy policies of any external site you visit.

11. Amendments to This Policy

We reserve the right to modify this Privacy Policy at any time. Material changes will be communicated to Members via an in-app notice, and the "Last updated" date at the top of this page will be revised accordingly. Your continued use of the App following the effective date of any amendment constitutes your acceptance of the revised Privacy Policy.
