Terms of Service

These Terms of Service ("Terms") govern your use of the Divine Rising NYC member app operated by Divine Rising NYC LLC ("Divine Rising," "we," "us," or "our"). By creating an account, you agree to these Terms.

1. The Service

Divine Rising NYC provides a membership-based family organization and community platform for New York City parents and guardians. The App is designed as a comprehensive advocacy and organizational companion, offering the following features:

• Document Vault — secure upload, storage, and management of IEPs, evaluations, school records, medical records, letters, and children's artwork, with the ability to share documents via email or text
• AI Advocacy Letter Generator — an AI-powered tool for drafting professional advocacy letters to schools, districts, and service providers, supporting input in multiple languages with output in formal English
• IEP Meeting Prep Organizer — a structured tool for organizing goals, notes, questions, and concerns before and during IEP meetings, with downloadable and Vault-saveable prep documents
• Family Calendar — a personal calendar for tracking IEP meetings, evaluations, benefits renewals, therapy appointments, and other important family dates
• Community — a members-only space for posting, commenting, sharing resources, and private messaging with other NYC families
• Children's Profiles and Gallery — child profile management and a gallery for storing and viewing uploaded artwork and school projects

The App's advocacy letter tools, IEP preparation guides, and calendar deadline suggestions are built specifically for NYC families navigating Early Intervention (EI), the Committee on Preschool Special Education (CPSE), and special education systems in New York City. Suggested dates and reminders are based on NYC-specific timelines and are intended to help families stay ahead of critical deadlines within these systems.

2. Membership and Payment

Access to the App requires an active membership subscription at the current rate of $30 per year. Payments are processed securely by Stripe. Upon payment, members receive immediate and full access to all App features for a period of one (1) year from the date of purchase. Subscriptions renew automatically on the annual renewal date unless cancelled prior to that date.

All membership fees are non-refundable. Because access to the App and all of its features is granted in full at the time of purchase, Divine Rising NYC LLC does not issue refunds for unused portions of a membership term, cancellations, or change of mind. By completing your purchase, you acknowledge and agree to this no-refund policy.

The sole exception to this policy applies to verifiable billing errors — including duplicate charges, unauthorized charges, or technical failures that prevented access to the App entirely. Billing error claims must be submitted in writing to Connect@divinerisingnyc.com within 14 days of the charge. We will investigate and, if the claim is valid, issue a full or partial refund at our discretion. This exception does not apply to dissatisfaction with the App's content or features.

To cancel your subscription and prevent automatic renewal, you must cancel before your renewal date through your account settings or by contacting us at Connect@divinerisingnyc.com. Cancellation stops future charges but does not entitle you to a refund for the current membership year.

3. Not Legal, Medical, or Educational Advice

The content in this app — including AI document summaries, letters, templates, checklists, and any other AI-generated content — is provided for informational and organizational purposes only. Nothing in this app constitutes legal advice, medical advice, educational advice, or professional advocacy services. Divine Rising NYC LLC is not a law firm, medical provider, or educational services agency.

AI-generated advocacy letters and AI document reviews are tools to help you organize and communicate your own concerns. They are not reviewed by attorneys, doctors, or advocates. You are responsible for reviewing any AI-generated content before relying on it, and for all decisions you make based on app content. Divine Rising NYC LLC is not liable for any outcome based on AI summaries or generated content.

Do not keep your documents solely on this app. This app is an organizational tool. Always maintain original copies on your own device, in email, or in another secure location.

Divine Rising NYC LLC is not a HIPAA-covered entity and does not provide HIPAA-compliant storage. You are responsible for what you upload.

For legal advice regarding your child's rights, please consult a qualified special education attorney or advocate.

4. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must be 18 or older to create an account. The app is intended for parents and guardians — not for use by minors.

You agree to provide accurate information when creating your profile and to keep it up to date.

5. Community Standards

By participating in the Community feature, you agree not to:

• Post content that is harassing, threatening, hateful, or discriminatory
• Share another member's private information without their consent
• Post spam, advertisements, or solicitations
• Impersonate another person or create a misleading username
• Post content that violates any applicable law

Divine Rising reserves the right to remove any content and suspend or terminate any account that violates these standards, at our sole discretion.

6. Your Content

You retain ownership of the documents, photos, and content you upload to the app. By uploading content, you grant Divine Rising a limited license to store and display it solely for the purpose of providing the service to you.

You are responsible for ensuring you have the right to upload any content you add to the app.

7. Privacy

Your use of the app is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it at divinerisingnyc.com/privacy.

8. Limitation of Liability

To the fullest extent permitted by law, Divine Rising NYC LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including reliance on any letter, document, or content generated through the app.

Our total liability to you for any claim arising from your use of the app shall not exceed the amount you paid for your membership in the 12 months preceding the claim.

9. Disclaimer of Warranties

The app is provided "as is" without warranty of any kind. We do not guarantee that the app will be error-free, uninterrupted, or that any particular result will be achieved from using it.

10. Termination

You may cancel your membership at any time. We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your access to the app will end and your data may be deleted in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. We will notify members of material changes by posting a notice in the app. Continued use after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of New York. Any disputes shall be resolved in the courts of New York County, New York.
